David Reyes Sentenced to 12 Years in State Prison for Robbery and Shooting Loss Prevention Officer

A defendant involved in a violent retail robbery at Macy’s on Pacific Avenue has been sentenced to 12 years in state prison following a guilty plea. The incident occurred on April 30, 2025, when a loss prevention officer (LPO) at Macy’s confronted two theft suspects, one of whom was the defendant, David Reyes, as they attempted to steal clothing items valued at over $500. As the defendant exited the store, the LPO identified himself as loss prevention and attempted to stop Reyes, who continued walking away. The LPO then grabbed the defendant from behind in a bear hug. The second suspect continued to flee and was pursued by another employee.

During the struggle, the LPO heard what sounded like a gunshot and immediately felt pain in his left thigh. He released the defendant, who fled the scene. Responding officers observed a through-and-through gunshot wound to the LPO’s leg, causing significant injury.

The defendant was later identified and apprehended using surveillance footage from the mall area, including cameras from Macy’s, JCPenney, and Weberstown Mall, which showed the defendant prior to the shooting.

Reyes was charged with robbery (Penal Code section 211) and a firearm enhancement (Penal Code section 12022.53). On December 3, 2025, the defendant pleaded guilty to the robbery charge and admitted the firearm enhancement under Penal Code section 12022.53(b).

On January 26, 2026, the defendant was sentenced to 12 years in state prison, consisting of 2 years for the robbery and a consecutive 10-year term for personal use of a firearm. This conviction qualifies as a strike, and the sentence will be served at 85 percent at the California Department of Corrections and Rehabilitation.

San Joaquin County District Attorney Ron Freitas stated, “This was a brazen act of violence that put lives at risk and left a loss prevention officer seriously injured for simply doing his job. Our office will continue to hold offenders accountable and work closely with our law enforcement partners and retailers to protect employees, customers, and our community from violent crime.”
