Kevin Fountain Sentenced to 17 Years in State Prison Following Probation Violation

Stockton, CA - San Joaquin County District Attorney Ron Freitas announced today that Kevin Fountain, 28, of Stockton, was sentenced to 17 years in state prison by the Honorable Judge Soldati after violating his probation. Fountain, a repeat offender with two prior strike convictions, was held accountable thanks to the diligent work of law enforcement and the prosecution team.

In February 2023, Fountain was arrested and charged with first-degree burglary. He pled no contest to the charge and admitted his prior strike convictions—first-degree burglary in 2019 and assault with a deadly weapon in 2020. In October 2023, the Honorable Judge Villapudua suspended a 17-year state prison sentence on the condition of Fountain’s successful completion of the Delancey Street program. However, Fountain abandoned the program within a week and subsequently committed a new crime involving organized retail theft, attempting to steal over $3,000 worth of merchandise from a Target in Lathrop.

On November 13, 2024, Fountain was found to be in violation of his probation due to the new theft case, leading to today’s sentencing.

District Attorney Ron Freitas commended Deputy District Attorney Jocelyn Weisbrich for her exemplary prosecution of the case, ensuring that justice was served and that a dangerous repeat offender was removed from the community.

“I am grateful for the dedication of our prosecutors and the outstanding work of law enforcement in holding repeat offenders accountable,” said District Attorney Ron Freitas. “The actions of Kevin Fountain reflect a clear disregard for rehabilitation opportunities and public safety, and this sentence sends a strong message.”
